# you make your money when you buy the land

*how to buy land below market value, and why the living work is the part the deed price missed*

The old line in real estate is that you make your money when you buy, not when you sell. Buy below what a property is worth and the upside is already there on closing day. The question is where the discount comes from.

**You buy land below market value where the market can't see the value or can't wait for it:** an owner on a clock, a parcel the listing services overlook, a seller who would rather take less cash plus a tax benefit, or a property whose appraisal prices the dirt and skips the living work. Ensurance adds one more reading to that list. The deed price leaves out what the land does in a year, and the parcel's account shows the difference.

This is not tax or legal advice. Use your own CPA and counsel for anything that touches a deduction, a basis or an exchange.

**the spread at purchase is the upside, and the living work is the part the deed price missed.** Buy right, keep the place alive, and you never have to sell it to be paid.

## a ranch the appraisal can't see

Picture a few hundred acres of sagebrush and hay meadow with a creek down the middle. The owner is in his seventies and the kids live in Denver. The appraiser looks at comparable sales and calls most of it "unimproved." It has no road frontage on the back half, and part of it is wet every spring.

Every one of those facts pushes the price down. Several of them are why the place is worth keeping. The wet ground stores snowmelt and keeps the creek running into late summer. The sage holds the soil and the birds. The ranch next door waters its cattle from that creek. An appraisal prices the sale; it does not price that work. That is covered in [what a real estate appraisal prices](/guide/what-a-real-estate-appraisal-prices?from=guide).

The ranch does that work whether anyone buys it or not. The deal decides who holds it, and whether the work continues.

## where this sits on the value gap

A place has a **cost** (land, project, the people doing the work), a **value** (what the living system does in a year, by a published method) and a **price**. In ensurance, a certificate is priced on cost. The **gap** is the living work the deed price does not carry. Owning the ground is the most direct seat on [the value gap](/guide/the-value-gap?from=guide): you buy at the deed price, and the gap comes with the title.

Nobody gets paid until someone pays. The protocol's bid follows payments that have actually been made, never the valuation. A buyer who wants a quick multiple should look elsewhere. A buyer who wants a discount that is real, plus income and a place that stays whole, is in the right lane.

## five ways to buy below market

| Path | Where the discount comes from | What the buyer gets | Who it fits |
|---|---|---|---|
| **motivated or overlooked parcels** | Estates, owners stepping back, absentee heirs, odd shapes, wet ground, no frontage | A price under comparable sales | Investors and operators with patience |
| **bargain sale** | The seller takes less cash and a charitable deduction for the difference | Title below market value | Qualified charitable buyers only |
| **donation that pays back** | A gift with a retained life estate or a remainder trust | Land arriving later, at no purchase price | Charitable buyers; donors who want income or use for life |
| **1031 into living land** | Not a discount on price, but deferred tax on the dollars you buy with | Titled land bought with pre-tax proceeds | Investors selling appreciated property |
| **own and operate** | Buying what others won't run, then running it | Rent, services and the work the land does | Long-term holders |

### motivated and overlooked parcels

This is the old trade. A scout or a records search finds an owner who needs to move, or a parcel nobody has priced right. The sorting runs through a licensed brokerage, Andrus & Morgan. A property with a strong conventional use goes to a conventional deal, a living one goes toward ensurance, and a mixed one can go both ways. The discount is real when it comes from the seller's timing or the market's blind spot. A discount that comes from pressure on a seller is not one worth taking.

### bargain sales

A **bargain sale** is a sale below fair market value to a qualified charitable organization. The seller gets cash at closing and a charitable deduction on the difference, on one deed. The buyer pays less than market by design. Only a qualified organization can sit on the buying side; BASIN Foundation can be that buyer when a parcel fits. The full walkthrough is in [what a bargain sale actually is](/guide/what-a-bargain-sale-actually-is?from=guide). An investor's seat in that deal is in how the purchase is funded, which [where you sit in a blended finance stack](/guide/where-you-sit-in-a-blended-finance-stack?from=guide) covers.

### donations that pay back

Some owners would rather give than sell, as long as the gift pays them. A retained life estate lets them live on the land for life. A charitable remainder trust can pay them income. The land arrives later, without a purchase price. Ensurance structures donations; the vehicles are in [the tax play: donating land that pays you back](/guide/the-tax-play-donating-land-that-pays-you-back?from=guide).

### 1031 into living land

If you are selling investment real estate, a 1031 exchange lets you defer the tax by rolling the proceeds into other real property, through a qualified intermediary. You identify replacement property within 45 days and close within 180 (or by your return due date, if that comes first). Real property held for investment is like-kind to other real property, so farmland, timber and ranch land can qualify. A certificate cannot; [a certificate is not like-kind](/guide/a-certificate-is-not-like-kind?from=guide), the land is. A 1031 desk inside the brokerage is planned. Start with [how to 1031 into living land](/guide/how-to-1031-into-living-land?from=guide).

### own and operate

KTH is the own-and-operate arm. It buys real estate others undervalue, runs it, and keeps the output: rent, services and the work the land does, rather than flipping the asset. A park with a wetland buffer is a rental property and a natural asset at once, read by the same system. Cash flow from operations can fund the next acquisition.

## what the account adds

Once a parcel is in ensurance, it has an **account**: an agent for the place and a record on [natural assets](/natural-assets?from=guide) that reads its condition, stocks and flows by a published method. That record is what shows the gap. The deed says what you paid. The account says what the land does.

From there, the parcel can earn without being sold:

- **A certificate priced on cost** can fund the stewardship. When it sells, the sale price goes to the parcel's account or a split.
- **Dependents can pay for what they rely on.** The ranch downstream, the water district or an insurer can pay a premium toward the flow that protects them.
- **An owner can hold title as the ensurer** while the policy runs, with proceeds and premiums servicing the hold until the parcel reaches entrust.
- **The certificate can reprice** as payment arrives. The upside lands in the instrument, not in a sale of the place.

Two things to keep straight. Ensurance is based on nature. A certificate is not a deed, and no coin or certificate is redeemable for land.

## four yields from buying right

| Yield | What it is here | Where it reads |
|---|---|---|
| **financial** | The spread at purchase; rent and operating income; the tax treatment of the deal; premiums and certificate sales into the parcel's account | The closing statement, the rent roll, the parcel's account |
| **ecological** | The creek, the wet meadow and the sage held in working condition, and improved where work is done | The parcel's record on natural assets |
| **social** | A seller who leaves with cash and a place intact; local crews paid to keep it | The agent, its group, who gets paid |
| **cultural** | A family's ranch that stays a ranch instead of becoming lots | The record and the people who answer for it; never a cash payout |

## where to start

If you own land and are weighing a sale below market, read [sell land without losing the place](/guide/sell-land-without-losing-the-place?from=guide) and [how to start a conservation land deal](/guide/how-to-start-a-conservation-land-deal?from=guide). If you are an investor looking to buy, [solutions for investors](/solutions/investors?from=guide&topic=every-way-the-work-pays) lays out the doors. If you want to give, start at [donate](/donate?from=guide).

Or bring the parcel. [Talk to us about a specific piece of land](/contact?from=guide&topic=every-way-the-work-pays): where it is, what it does, and what the owner needs. The ranch was working before the appraiser came by. Buying it right means paying the price the market set and keeping the work the market missed.
