what new water actually is

utilities already have a name for created supply — and it is not the same as a wetter river

Stand on a bridge over a river that has gone to a trickle and the obvious question is not how do we use less? It is where do we get more?

That question already has an answer in the water business, and it already has a name: new water. What most people miss is that the phrase means two different things — and only one of them has a state fund named after it.

the phrase is already in the statute book

what is new water?

New water is supply that did not previously exist for a given system — gallons created or newly brought in, rather than gallons freed up by using less. In utility and state planning it means desalination, potable and non-potable reuse, produced-water treatment (oilfield wastewater), aquifer storage and recovery, and imports or transfers. Conservation is not new water. It is the same water, spent more carefully — and still required.

This is not our coinage. It is ordinary trade language, and in at least one state it is statute. Texas created the New Water Supply for Texas Fund in 2023, and the water code directs the board to finance projects "that create new water sources for the state" — naming marine and brackish desalination, produced water treatment, aquifer storage and recovery, and the infrastructure to move the result — with a stated target of seven million acre-feet of new water supplies by December 31, 2033. The 2025 session widened what the Texas Water Fund can finance to include reuse and out-of-state acquisition — a neighboring pot, not the New Water Supply Fund list itself.

Read that list once more and notice its shape. Most items are a plant, a well field, or a pipe. Each is real, metered, and financeable, which is exactly why the category exists. One of them — aquifer storage and recovery — is storage, not creation; the statute is looser than the label. And not one of them makes a river wetter upstream of the intake.

the second dialect: water made on the land

There is a second use of "new water," and it belongs to hydrologists, ranchers, and restoration crews rather than to bond counsel.

In this dialect, new water is the water a landscape produces because it can once again catch, hold, and recycle what falls on it. Rain that used to sheet off compacted ground infiltrates instead. Soil with structure and organic matter holds it. Wetlands, floodplains, and beaver complexes keep it in the valley through summer rather than flushing it downstream in a week. Water tables come up. Streams that used to go dry in August keep a thread of late-season baseflow. Vegetation that is no longer water-stressed transpires, putting moisture back into air that moves downwind.

None of that arrives at a meter, which is a large part of why it has been invisible to the funds that pay for supply.

Slovak hydrologist Michal Kravčík and his co-authors gave this idea a name in Water for the Recovery of the Climate: A New Water Paradigm (2007), arguing for systematic rainwater retention as both supply and climate policy. That work is a cousin to what we are describing, not the parent of it — the same mechanism turns up independently in soil science, beaver ecology, and floodplain reconnection, with no paradigm attached.

One honest bound. How much retained moisture comes back as local rain varies enormously by region, season, and what sits upwind. It is well supported in well-vegetated continental interiors and weak downwind of a desert, so nobody should sell you a rainstorm — see you can't seed a cloud that isn't there. Soil moisture, recharge, and late-season flow are the dependable part. Local rainfall is the regionally variable part, and it should be described that way.

All three belong in a serious portfolio. They are not substitutes for each other, and the honest failure mode of each sits in that last column.

can you create water?

Not in the sense of manufacturing H₂O out of nothing. That is not a thing, and any pitch implying otherwise should end the meeting. Two real senses of "create" remain, and both are ordinary engineering and ecology.

A desalination plant creates usable freshwater by separating it from salt. Reuse creates usable freshwater by treating what was already spent. Landscape restoration creates usable freshwater by changing the fate of water that already arrives — turning runoff into storage, and storage into flow that shows up months later, in the dry part of the year, when it is worth the most.

Creating water is not alchemy. It is changing the fate of water that already falls.

how is new water different from water conservation?

Conservation is demand-side: it changes how much you withdraw. New water is supply-side: it changes how much there is to withdraw from. Using twenty percent less of an inflow that has lost most of its volume still leaves a trickle — a smaller share of a smaller thing.

That is not an argument against conservation. Efficiency is cheap, fast, and required, and wasting water in a drying basin is indefensible. It is an argument against counting conservation as supply. conservation does not create water takes that mechanism apart in full.

a dry river is a production failure

When a river drops to a trickle, three separate things are usually happening at once, and they get argued about as though they were one.

The weather half is real — heat, thin snowpack, rain that moved. The allocation half is real too: who holds what right to whatever is left. The production half rarely makes the agenda. That is the catchment itself — drained, compacted, paved, stripped of the wetlands and deep-rooted vegetation that used to convert rainfall into stored water and release it slowly.

A dry river is a production failure as much as an allocation fight, and you cannot fix a production failure by dividing the output more carefully.

Conservation and water law both operate on the output. A plant adds gallons somewhere else entirely. Only work on the land touches production.

the foundation is the place

To be plain about our own role: ensurance does not create water. Hydrology does. The foundation is the natural asset — a named wetland, headwaters parcel, floodplain, or recharge zone whose stocks and flows can be measured and ensured. Nature-based solutions (rewetting, beaver complexes, floodplain reconnection) are what you do on that asset to restore production. They are the second job. The first job is the place itself.

Ensurance is the mechanism that funds the underlying — that natural asset — so the people who depend on it pay for its present condition instead of paying for the shortage afterward. A certificate attaches that funding to one named place. It is not a title to the land or its water. We are early and our volumes are small, and we would rather say that than oversell it.
