# sell land without losing the place

*the highest bidder is not the only buyer. conservation is still a sale.*

Sell land, and the script is always the same: list it, take the highest bid, and watch the living cover go under a subdivision. Families hear that as a binary — we need the money, or we cannot be the ones who kill this place.

The highest bidder is not the only buyer. Conservation is still a sale. The cash can still show up at closing. The grass, the wet acre, the timber, and the creek do not have to be the first things that die.

**you don't have to choose between cash and keeping the land alive.** Selling to conservation is still a sale. The difference is who the buyer is for.

## the false choice: list it or lose it

The conventional listing treats the parcel as empty capacity. Grass is landscaping until it is lots. A wet acre is a drainage problem. Timber is a board-foot number. A creek is frontage. The buyer who will pay the most is often the buyer who needs those things gone.

So the kitchen table splits into two chairs. One says: we need the money. The other says: we cannot pave this. The listing does not offer a third chair.

Land trusts, public agencies, and conservation-minded buyers have been that third chair for a long time. A conservation sale is not a donation in disguise, and it is not a fire sale. It is a land deal whose buyer is for the living cover, not against it.

If you are not selling — if you want the land to pay you while you keep the deed — that is a different conversation: [how to earn income from conservation land you own](/guide/how-to-earn-income-from-conservation-land-you-own?from=guide). This post is for owners who are going to sell, and who still care what stays standing.

## three doors that still pay you

We do not run a public MLS. There is no listing grid on this site, and we will not invent one. The work starts with a parcel, not a catalog.

What we actually have — and what land conservation has always had — are three doors that still move cash and title. The first row of the table is the listing everyone already knows. It is the false choice, not a door we are selling.

| door | what you get | what happens to the place |
|------|----------------|---------------------------|
| conventional listing | cash from whoever bids most | the living cover is not the buyer's job |
| conservation buyer, brokered | cash at closing | a buyer whose purpose is the habitat |
| BASIN direct offer | cash, when the parcel fits | we hold it for conservation or restoration |
| bargain sale or gift | some cash, or none, plus a charitable difference | title moves to a qualified organization |

None of the last three require you to pretend the grass was never there.

### a conservation buyer

A conservation buyer is a purchaser whose job is the living place, not the highest development yield. That can be a land trust, a public agency, a family, a fund, or a neighbor who intends to hold the habitat. The deed still transfers. Money still changes hands. The difference is what they are allowed — and willing — to do after close.

BASIN can broker that sale: connect a landowner with a qualified conservation buyer and structure the close so protection is part of the deal, not a handshake after the fact. We coordinate. We did not invent the category, and we do not promise a buyer for every listing. To start a brokered sale, [talk about this parcel](/contact?from=guide&topic=land-deal).

### a BASIN direct offer — when it fits

Sometimes the right buyer is us. BASIN can make a direct acquisition offer when a property matches a conservation or restoration mandate. Creek, wet meadow, working grassland, timbered slope — the living system on the deed is the reason, not a marketing line.

Not every parcel is a fit. Problem title, contamination, a location with no conservation case — we will say so rather than advertise a purchase we will not make. Direct acquisition is case-by-case. If it is not a fit, the brokered door and the gift door are still on the table.

### a bargain sale or a gift

If you need some cash and still want the rest of the value to go with the place, that is a [bargain sale](/guide/what-a-bargain-sale-actually-is?from=guide): you sell below fair market value to a qualified organization, take cash at closing, and treat the difference as a gift. It is not a fire sale. It is how you get paid and the habitat stays.

If you do not need the cash, the gift path already exists — [how to donate property](/guide/donate-property?from=guide) — and we will not rewrite it here. A gift or bargain-sale inquiry can start at [donate](/donate?from=guide).

This is not tax advice. A bargain sale splits basis between the sale and the gift; your CPA and counsel run the numbers, including a qualified appraisal and Form 8283 when the gift is large enough. We structure the land deal. They structure the return.

## what actually dies

People talk about "losing the land" as if the deed were the place. Title matters — but the meadow is not the legal description. What dies under a subdivision is the living cover: the grass that still holds the soil after a dry June, the wet acre that soaks a storm before it hits the road, the timber on the north slope, the creek that runs muddy after a hard rain and clear by June.

Those things exist whether or not anyone later buys a certificate or funds stewardship. They existed before the listing. They will not exist in the same way after the lots.

A conservation sale is how you sell land without making that the closing gift to the county.

## after the deed

The land deal is how title and cash move. What happens to condition after close is a separate question. [ensurance](https://ensurance.app/?from=guide) can fund the living cover — restoration, stewardship, the work that keeps grass, wet acre, timber, and creek in working order — after the deed, or alongside it. A [certificate](/specific?from=guide) — specific ensurance tied to a named place — is one way to fund stewardship after close. It is not the meadow. It is not why the creek is there. Onchain volumes are small; the deed and the habitat are the main event.

If you want the acres to stay living, that is the subject of [conservation land is still a living place](/guide/conservation-land-is-still-a-living-place?from=guide).

## frequently asked questions

### can you sell land and still protect it?

Yes. Selling the fee to a conservation buyer, taking a direct offer from an organization that will hold the habitat, closing a bargain sale, or [selling the development rights while you keep the deed](/guide/keep-farming-sell-the-development-rights?from=guide) are still land deals. You can leave with cash and leave the living cover standing. Protection is a function of who buys, what interest moves, and what they are bound to do — not of refusing to transact.

### who buys conservation land?

Land trusts, public agencies, conservation-minded families, impact funds and family offices buying habitat acres, and organizations with a conservation or restoration mandate. The Land Trust Alliance counts 61.1 million acres under land-trust protection in the United States — more than all national parks. That inventory was bought, donated, and placed under easement over decades. There is no public MLS for it here. Buyers are found, not browsed.

### what is a conservation buyer?

A conservation buyer pays for title (or for the development rights) so the living cover stays — not so lots replace the grass, wet acre, timber, and creek. Same sale mechanics as any purchase; different job after close.

## if you are going to sell

Say what you want to stay standing. That is the whole brief: the creek, the hay meadow, the timbered slope, the wet corner the county keeps calling a ditch. Name the money need (all cash, some cash, mostly a gift). Then pick a door.

If cash and a gift on one closing might fit, read [what a bargain sale actually is](/guide/what-a-bargain-sale-actually-is?from=guide) first. If the question is what the buyer is actually purchasing on the ground, read [conservation land is still a living place](/guide/conservation-land-is-still-a-living-place?from=guide). If the asset you can move is a building, not a pasture, start at [sell my commercial property to conservation](/guide/sell-my-commercial-property-to-conservation?from=guide). If you want to keep farming and sell only the right to subdivide, that is [keep farming, sell the development rights](/guide/keep-farming-sell-the-development-rights?from=guide). When you are ready to send the parcel, [how to start a conservation land deal](/guide/how-to-start-a-conservation-land-deal?from=guide) is the how-to.
