# buy the land-use decision

*ownership and protective rights give funding a way to change what can happen on the ground*

A meadow can receive funding every year and still be sold for another use. To change that, the protection has to reach the rights that decide what happens on the ground.

**Property rights for nature protection** means acquiring or legally restricting the relevant rights over a real place: buying the land, securing a conservation easement, or another arrangement that binds the use you need to protect. The right structure depends on the land, the people with authority over it and the applicable law.

Real property law supplies a way to secure the meadow's future use. [*Ensurance*](/specific?from=guide) funds that protection through a Natural Asset Policy written with a cooperating titleholder.

## find the decision that can change the place

Imagine a hypothetical wet meadow used by a herd in winter and fed by a small creek. The immediate threat is drainage followed by subdivision. A fence repair helps the herd today. A stewardship payment helps the owner carry the property. Neither necessarily prevents a successor from pursuing a different lawful use.

The protection brief therefore asks who can authorize drainage, development, water diversion or extraction, and which of those decisions the proposed transaction can bind. Existing law may already limit some uses. Existing leases or severed rights may put others in someone else's hands.

A parcel boundary identifies the land to investigate. It does not tell you that one seller holds every right the meadow depends on.

## choose the right to secure

Conservation organizations already use acquisition and property restrictions to protect land. The choice is about what needs to change and who should hold the responsibility afterward.

| route | what it can secure | what still needs resolving |
|---|---|---|
| Fee acquisition | Ownership of the interests conveyed, giving the buyer authority to make land-use decisions within the law. | Existing rights, liabilities, carrying costs and restrictions that will bind a later owner. |
| Conservation easement or comparable restriction | Specified limits on use while an owner retains the remaining interests. | Valid creation and recording, an eligible holder where required, enforcement, priority and amendment terms. |
| Acquisition or retirement of development rights | Control over defined development rights, through a mechanism recognized locally. | Whether those rights cover the actual threat, and whether water, mineral or other interests remain outside it. |
| Lease or management agreement | Access and control over agreed activities for its term. | Expiry, renewal, termination and what happens when the agreement ends. Term control alone is not permanent protection. |

Buying the fee enables control; a future owner may otherwise retain the same power to change the use.

## one purchase, carried through

In the hypothetical meadow, an authorized conservation entity agrees to buy from the willing owner. It combines funding committed through the watershed account with separately documented acquisition capital, completes the purchase and records the deed as required. The entity holds title. The watershed account remains a source of funding.

As cooperating titleholder, the entity commits the parcel to a Natural Asset Policy. The agreed funding plan pays the protection cost and retires acquisition claims. Appropriate property documents secure the protected use against successors, with an enforcement holder and a care budget. Entrust requires both legal completion and the agreed financial clearance. This is an illustrative route, not a transaction already completed.

The [three ways to hold a natural asset](/guide/three-ways-to-hold-a-natural-asset?from=guide) separate deed ownership, acquisition financing and certificates. A Natural Asset Policy certificate funds the protection pathway; holding that certificate does not convey the property interests in this table.

## name the parties who can actually sign

An account addressed to a watershed can organize resources for a meadow. It cannot acquire the meadow merely by naming it. The transaction needs a buyer or rights holder capable of holding the interest, the necessary owner agreement and people authorized to execute the documents.

Keep three roles visible: who operates the account, who holds the property interest, and who enforces protection. Any overlap must be established in the agreements.

Owner consent also sits within a wider legal and political setting. Indigenous sovereignty, customary and community rights, public-land authority and existing occupancy do not disappear because a private deed or protocol account appears. Determine the appropriate authority and required consent for the place. A funding mandate creates neither representation nor permission over other people.

## test the protection against a change of hands

Before calling a structure durable, put four questions beside the proposed documents:

1. **What is covered?** Identify the parcel, the protected uses and any water, mineral, access or development rights held separately.
2. **What takes priority?** Identify mortgages and other senior interests, and establish whether a foreclosure or exercise of those rights could defeat the protection.
3. **Who is bound next?** Determine which obligations bind successors, how they are recorded where required, and who can amend or terminate them.
4. **Who can enforce it?** Name the party with standing, the monitoring responsibility and the resources available when a restriction is breached.

A trust or an LLC can help hold the land and organize responsibility. A purpose clause in its governing documents is not automatically a restriction that binds every later owner. The legal structure must do the particular job claimed for it.

## put the policy beside the property documents

Read the Natural Asset Policy beside the property documents: what the account funds should match the rights and obligations the legal parties can deliver.

Bring one parcel, its rights and its proposed protection documents to the next conversation. Then ask the question that matters after the closing: [will the protection survive us?](/guide/permanent-protection-has-to-survive-us?from=guide)
